We reserve the right to accept, refuse, or cancel an order where reasonably necessary, including in cases involving product unavailability, suspected fraud, unauthorized resale, incorrect pricing or product information, payment problems, shipping restrictions, violation of these Terms, or technical errors.
An automated order confirmation or order number acknowledges receipt of your order but does not necessarily constitute final acceptance where further payment, fraud, inventory, or fulfillment verification is required.

Jovellee currently ships to the United States and selected international destinations.
Available shipping destinations, shipping methods, estimated delivery times, and applicable shipping charges vary depending on factors including the delivery destination, order subtotal, products included in the order, selected shipping method, and carrier availability.
The shipping options and charges available for your specific order will be displayed at checkout before payment.
Order processing and delivery times displayed on our website are estimates and may vary due to product preparation, shipping destination, carrier delays, holidays, weather conditions, customs clearance, transportation disruptions, or other circumstances outside our reasonable control.
Customers are responsible for providing accurate and complete shipping information. Jovellee is not responsible for delays, failed deliveries, or additional shipping costs resulting from incorrect, incomplete, or outdated shipping information provided by the customer.

SECTION 8 - RETURNS, REFUNDS AND CANCELLATIONS
Returns, refunds, and order cancellations are governed by our Refund Policy.
Eligible return requests must be made in accordance with the timeframes, conditions, and procedures described in our Refund Policy.
Standard-size items may be eligible for return subject to the conditions stated in our Refund Policy. Certain custom-made, custom-size, custom-color, or custom-style products may not be eligible for return due to fit, personal preference, or change of mind.
Jovellee currently does not offer direct exchanges. If you need a different size, color, or style, an eligible item may be returned in accordance with our Refund Policy, and a new order may be placed separately.

Jovellee names, logos, product and service names, designs, and slogans are trademarks of Jovellee or its affiliates or licensors. Shopify names, logos, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans appearing on the Services are the property of their respective owners.
All rights not expressly granted in these Terms are reserved by Jovellee.
SECTION 10 - USER CONTENT, REVIEWS AND FEEDBACK
If you submit, upload, post, email, tag, share, transmit, or otherwise provide Jovellee with reviews, comments, photos, videos, suggestions, ideas, proposals, feedback, testimonials, social media content, or other materials, whether through our website, email, social media, third-party platforms, or otherwise (collectively, "Feedback"), you grant Jovellee a perpetual, worldwide, irrevocable, sublicensable, transferable, royalty-free license to use, reproduce, modify, adapt, translate, publish, distribute, display, perform, create derivative works from, and otherwise exploit such Feedback in any medium and for any purpose, including commercial, advertising, marketing, promotional, product development, and business purposes.
You represent and warrant that:
(i) you own or have all necessary rights to submit the Feedback;
(ii) the Feedback does not violate any third-party rights, including copyright, trademark, privacy, publicity, personality, or other personal or proprietary rights;
(iii) the Feedback is accurate and not misleading;
(iv) the Feedback complies with these Terms and applicable law;
(v) you have disclosed any compensation, incentive, discount, free product, or other benefit received in connection with your Feedback.
Jovellee is under no obligation to keep Feedback confidential, pay compensation for Feedback, use Feedback, respond to Feedback, or return Feedback.
We may, but have no obligation to, monitor, edit, remove, refuse, or delete Feedback that we determine, in our sole discretion, to be unlawful, offensive, threatening, abusive, defamatory, obscene, pornographic, misleading, infringing, inappropriate, or otherwise objectionable.
You are solely responsible for any Feedback you submit and its accuracy, legality, and appropriateness. We assume no responsibility or liability for Feedback submitted by you or any third party.

SECTION 13 - RELATIONSHIP WITH SHOPIFY
Jovellee is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.
However, any sales, purchases, orders, refunds, returns, customer service communications, product issues, shipping issues, and other transactions made through our online store are made directly between you and Jovellee.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales or transactions between you and Jovellee, including products purchased from Jovellee, product quality, product safety, order fulfillment, shipping, delivery, returns, refunds, customer disputes, injuries, damages, losses, or claims arising from products or services purchased through Jovellee.
You hereby expressly release Shopify and its affiliates from all claims, damages, losses, liabilities, costs, and expenses arising from or related to your purchases, transactions, communications, or interactions with Jovellee to the fullest extent permitted by applicable law.

(e) to submit, transmit, or display intentionally false, fraudulent, or materially misleading information;

(j) to intentionally interfere with, bypass, disable, circumvent, or compromise security, authentication, access controls, CAPTCHA systems, rate limits, or other protective measures;
(k) to use automated systems in a manner that materially disrupts, overloads, damages, circumvents, or interferes with the Services;
(l) to reproduce, duplicate, sell, resell, exploit, or commercially use protected portions of the Services without authorization.
The restrictions on automated access in these Terms do not prohibit bona fide search engine crawlers, ecommerce platform services, payment providers, security services, marketplace or advertising platform services, analytics services, or other automated systems that Jovellee authorizes or permits through its technical settings, integrations, or applicable platform configurations.
We reserve the right to take reasonable measures to restrict access that violates this Section.
SECTION 19 - AGENTS AND AUTOMATED ACCESS
Automated systems that are not otherwise authorized by Jovellee may not access or interact with the Services in a manner that circumvents security measures, disrupts normal operation, extracts protected information for unauthorized commercial purposes, or violates applicable law.
This Section does not apply to authorized or permitted services used in connection with operating, securing, indexing, advertising, analyzing, processing payments for, or otherwise supporting the Services, including legitimate search engine crawlers and ecommerce platform integrations.
We may use reasonable technical measures to manage or restrict unauthorized automated access.
SECTION 20 - TERMINATION
These Terms remain effective unless and until terminated by either you or Jovellee.
You may terminate these Terms at any time by discontinuing your use of the Services and, where applicable, notifying us that you no longer wish to use the Services.
We may terminate, suspend, restrict, or disable your access to all or part of the Services at any time, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent, abusive, harmful, or unlawful activity, misused the Services, or created risk or potential legal exposure for Jovellee, Shopify, our customers, or any third party.
Upon termination, your right to access and use the Services will immediately cease. Any obligations and liabilities incurred before the termination date will survive termination.
The following sections will survive termination: Intellectual Property; User Content, Reviews and Feedback; Relationship with Shopify; Privacy Policy and Personal Information; Prohibited Uses; Agents and Automated Access; Termination; Disclaimer of Warranties; Limitation of Liability; Indemnification; Severability; Waiver; Entire Agreement; Assignment; Governing Law; and any other provisions that by their nature should survive termination.
SECTION 21 - DISCLAIMER OF WARRANTIES

Except as expressly stated by Jovellee or required by applicable law, the Services are provided on an "as is" and "as available" basis.
To the fullest extent permitted by applicable law, Jovellee disclaims warranties or conditions that may lawfully be excluded, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, title, non-infringement, availability, and similar implied warranties.
We do not guarantee that:
(i) the Services will always be uninterrupted or error-free;
(ii) every technical error will be corrected immediately; or
(iii) the Services will be completely free from harmful components beyond what reasonable security measures can prevent.
Nothing in these Terms limits statutory warranties, consumer guarantees, or other rights that cannot legally be excluded or restricted.
SECTION 22 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO CASE SHALL JOVELLEE, SHOPIFY, OR THEIR RESPECTIVE AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, SUPPLIERS, OR REPRESENTATIVES BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, BUSINESS INTERRUPTION, LOSS OF GOODWILL, OR SIMILAR DAMAGES.
This limitation applies to damages arising from or related to:
(i) your use of or inability to use the Services;
(ii) products purchased through the Services;
(iii) errors, inaccuracies, or omissions in content;
(iv) service interruptions, delays, or unavailability;
(v) shipping or delivery delays;
(vi) loss of data;
(vii) unauthorized access to or use of information;

(ix) any other claim related in any way to your use of the Services or any product purchased through the Services.
This limitation applies whether based in contract, tort, negligence, strict liability, warranty, statute, or any other legal theory, even if advised of the possibility of such damages.
To the fullest extent permitted by applicable law, Jovellee's total liability for any claim arising from or related to the Services or any product purchased through the Services shall not exceed the amount paid by you to Jovellee for the product or service giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Jovellee, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, service providers, suppliers, and representatives from and against any losses, damages, liabilities, claims, demands, judgments, settlements, penalties, costs, and expenses, including reasonable attorneys' fees, payable to any third party due to or arising out of:
(i) your breach of these Terms or any policies incorporated by reference;
(ii) your violation of any applicable law, regulation, rule, or ordinance;
(iii) your violation of any rights of a third party, including intellectual property, privacy, publicity, or proprietary rights;
(iv) your access to or use of the Services;
(v) your misuse of the Services;
(vi) any Feedback, content, information, or materials you submit or provide through the Services;
(vii) your fraud, negligence, willful misconduct, or unauthorized activity.
We will notify you of any indemnifiable claim, provided that failure to promptly notify you will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent, not to be unreasonably withheld. You agree to cooperate in the defense of indemnified claims, including by providing relevant documents and information.

If any provision of these Terms is determined to be unlawful, void, invalid, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law.
Any unenforceable portion shall be deemed severed from these Terms, and such determination shall not affect the validity or enforceability of any remaining provisions. The remaining provisions shall continue in full force and effect.

The failure of Jovellee to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
These Terms, together with any policies, notices, or operating rules posted by us on the Services or incorporated by reference, constitute the entire agreement and understanding between you and Jovellee regarding your use of the Services.
These Terms supersede any prior or contemporaneous agreements, communications, representations, proposals, or understandings, whether oral or written, between you and Jovellee, including any prior versions of these Terms.
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
SECTION 26 - ASSIGNMENT
You may not delegate, transfer, or assign these Terms or any of your rights or obligations under these Terms without our prior written consent. Any attempted assignment without our consent will be null and void.
We may transfer, assign, or delegate these Terms and our rights and obligations without your consent or notice, including to affiliates, successors, acquirers, business partners, or entities involved in a merger, acquisition, corporate reorganization, sale of assets, or transfer of business.
